We’ll explain the trio of pregnancy laws (PDA, PWFA, & the PUMP Act), their legal framework, limitations, & accommodations under each.

Course Overview:

With the newer generation entering the workforce, pregnancy laws have been strengthened to support those who choose to start families. The Pregnancy Discrimination Act (PDA), the Pregnant Workers Fairness Act (PWFA), and the Pump for Nursing Mothers Act (PUMP Act) are designed to protect and support pregnant and nursing employees.

Referred to as the “NEW” Bermuda Triangle of laws, these have been causing confusion for employers and creating significant risks for discrimination/ retaliation claims. The difficulty arises from navigating each law’s requirements and balancing them with accommodations relating to employees’ rights.

Listen as Ms. Janette S Levey, an experienced Employment Attorney, provides an overview of the PDA, PWFA, and the PUMP Act frameworks and when employers are required to provide accommodations to eligible employees.

We’ll also weave in the different state and local laws that also come into play when you’re dealing with pregnancy and lactation accommodation laws at the state and local level.
