COURSE OVERVIEW:
The major provisions of the FLSA are concerned with minimum wage rates, overtime payments, child labor, and equal rights.
We’ll discuss notable developments in 2024/25 that include the DOL’s final rule on independent contractor classification, current thresholds for overtime eligibility, etc.
To determine FLSA exemptions, employers must evaluate the primary duties of a job and apply specific tests, including the Salary Level and Salary Basis tests. Proper classification as exempt or non-exempt is essential to ensure compliance, as it determines overtime eligibility.
Employers must also understand how to calculate overtime pay, adhere to minimum wage and equal pay provisions, and comply with recordkeeping regulations. Failure to comply with Wage and Hour laws may result in the employer paying the employee back wages, damages, penalties, attorney fees, and court costs, plus the prospect of civil and criminal penalties from federal and/or state governments. Therefore, Wage and Hour compliance is of the utmost importance.
